By creating an account or using our services on behalf of an educational institution, you represent that you have the authority to bind that institution to these terms.

Description of Services

vectorhubnovaex provides student progress tracking analytics dashboards and related educational technology services to educational institutions. Our services include analytics platforms, progress monitoring tools, predictive analytics, data integration services, and custom reporting solutions designed specifically for educational environments.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice to our clients. We may also impose limits on certain features or restrict access to parts of our services without notice or liability.

User Obligations

Users of our services agree to use the platform responsibly and in accordance with all applicable laws and regulations. You must provide accurate and complete information when creating accounts or using our services, and you are responsible for maintaining the confidentiality of your account credentials.

Educational institutions using our platform agree to ensure they have appropriate rights and consents to process student data through our services. Users must not attempt to gain unauthorised access to our systems, interfere with the operation of our services, or use our platform for any unlawful or prohibited purposes.

Data Protection and Privacy

We are committed to protecting the privacy and security of all data processed through our platform. Our handling of personal data is governed by our Privacy Policy and applicable data protection laws, including GDPR for European users.

Educational institutions retain ownership of their student data and are responsible for ensuring they have appropriate legal bases for processing such data. We act as a data processor for student information and implement appropriate technical and organisational measures to protect this data.

Intellectual Property

The vectorhubnovaex platform, including all software, analytics algorithms, dashboard designs, documentation, and related materials, is protected by intellectual property laws and remains the exclusive property of vectorhubnovaex d.o.o.

We grant you a limited, non-exclusive, non-transferable licence to use our services in accordance with these terms. You may not copy, modify, distribute, sell, or lease any part of our services, nor may you reverse engineer or attempt to extract the source code of our software.

Payment and Subscription Terms

Our services are provided on a subscription basis with fees determined by the selected service package and institutional requirements. Payment terms are specified in individual service agreements with educational institutions.

Subscription fees are charged in advance and are non-refundable except as required by law. We reserve the right to modify our pricing with reasonable notice to existing clients. Failure to pay fees may result in suspension or termination of services.

Limitation of Liability

To the maximum extent permitted by law, vectorhubnovaex d.o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

Our total liability to you for any claims arising from or relating to these terms or our services shall not exceed the amount you paid to us in the twelve months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

Service Availability and Support

While we strive to provide reliable and continuous service, we do not guarantee that our platform will be available at all times or free from errors. We provide technical support during our business hours and will make reasonable efforts to resolve any issues promptly.

Scheduled maintenance and updates may require temporary service interruptions, for which we will provide advance notice when possible. We are not responsible for service disruptions caused by factors beyond our reasonable control.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Croatia. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Croatia.

For users located in other EU countries, you may also have rights under your local consumer protection laws. Nothing in these terms affects any statutory rights you may have as a consumer that cannot be waived or limited by contract.

Termination

Either party may terminate these terms and your access to our services at any time with reasonable notice. We may terminate or suspend your access immediately, without prior notice, if you violate these terms or engage in conduct that we reasonably believe is harmful to our services or other users.

Upon termination, your right to use our services will cease immediately. We will provide reasonable assistance in data export and transition, subject to the terms of your service agreement. Provisions of these terms that by their nature should survive termination will remain in effect.

Changes to Terms

We may modify these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. We will provide notice of material changes by posting the updated terms on our website and updating the "last updated" date.

Continued use of our services after any changes constitute your acceptance of the new terms. If you do not agree to the modified terms, you should discontinue use of our services.
